Terms of use

The shape of the agreement.

These terms govern your use of Forthly — the website, the application, and the coaching membership. By creating an account or joining a session, you agree to them. If you don't, please don't use the service.

What Forthly is, and isn't

Forthly provides coaching by clinically-trained coaches, paired with software for capturing context between sessions. Forthly is not a medical or psychiatric service, and it does not provide therapy, diagnosis, or treatment. If you are in crisis, please contact your local emergency services.

Eligibility

You must be 18 or older and able to enter a binding agreement. You agree to give accurate information and to keep your account credentials private.

Membership and payment

Membership renews monthly at the rate displayed when you joined. You can cancel any time from settings; cancellation stops the next renewal and you keep access through the end of the current period. Sessions not used in a given month do not roll over unless we say otherwise in writing.

Your content

You own what you write, record, or upload. You grant Forthly a limited license to store, process, and display your content solely to operate the service for you and your coach. We will not use your content to train third-party models. See the Privacy Policy for details.

Acceptable use

Don't use Forthly to harass another person, to share content that is unlawful or infringing, to attempt to access another account, or to disrupt the service. We may suspend accounts that do.

Coach relationship

Your coach is engaged through Forthly and bound by confidentiality. Forthly matches and supports the relationship; the conversation itself is between you and your coach. Coaches may decline to continue an engagement, and so may you, at any time.

Disclaimers

The service is provided "as is." Forthly does not guarantee specific outcomes from coaching. To the fullest extent allowed by law, we disclaim implied warranties and limit our aggregate liability to the amount you paid us in the twelve months before the claim.

Termination

You can close your account at any time. We may suspend or terminate accounts for material breach of these terms, for non-payment, or where required by law. On termination, the rights and obligations meant to survive — confidentiality, payment for services already rendered, limitations of liability — will survive.

Changes

We may update these terms. If a change is material, we will give notice before it takes effect. Continued use after the effective date means you accept the update.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts located there.
